Home Lifestyle Club Terms and Conditions

Whenever “Home Lifestyle Club” is used, it is meant to include without limitations Home Lifestyle Club, Home Lifestyle Club Inc., Home Lifestyle Club Studios and any and all persons related to or associated with Home Lifestyle Club, its affiliated organizations, parent corporation, subsidiaries, associates, successors and assigns, all of their respective directors, officers, partners, members, employees, instructors, agents, consultants, volunteers and contractors.

Whenever “Activities” is used it is meant to include without limitations Private Classes, Group Classes, Events, Activities, any other Programs, use of Equipment, and any other services provided by Home Lifestyle Club or wherever Home Lifestyle Club is providing Activities.

When you register for Activities at a Home Lifestyle Club facility, you are acknowledging that you have had sufficient time to read and understand the Home Lifestyle Club Terms of Service, and that you understand the information outlined. You also acknowledge that you are voluntarily waiving certain legal rights that you or your Legal Representatives may have and that you acknowledge that the Home Lifestyle Club Terms represents the entire agreement with respect to you taking part in Home Lifestyle Club Activities.

Terms must be agreed to prior to registering for Activities at Home Lifestyle Club Studios.

Your health is really important to Home Lifestyle Club. We advise you to consult with your physician prior to taking part in any Home Lifestyle Club activities.

Activities may be conducted in a specific environment. Lighting, music, and other factors may be present during Activities that may affect individuals with specific conditions. If you have any concerns or conditions that may be affected by these factors, do not participate in Home Lifestyle Club Activities.

By registering for Home Lifestyle Club Activities, you confirm that you are voluntarily participating in said Activities.

You acknowledge that you are aware of the inherent risks of physical activities such as but not limited to bodily injury, broken bones, disabling injuries, disease, slips, trips, falls, scratches, sprains, heart attacks, concussions, death or other ailments that could cause serious disability and cause damage to you or your property (Collectively the “Risks”).

You voluntarily release, indemnify and hold harmless Home Lifestyle Club from any and all responsibility, injury claims, damages, expenses, actions, suits, procedures, costs and or liabilities related to your participation in Activities. This includes but is not limited to the risks associated with such, whether in law or in equity, that you or any other person may have, suffer or incur as a result of your participation in the Activities or your presence at or near the premises due to any cause whatsoever, including, but not limited to negligence, gross negligence, trespass, breach of contract for any other person’s actions or omission, or breach of any statutory or other duty of care, to the fullest extent allowed by law.

You acknowledge and accept on behalf of yourself, your heirs, representatives and or assigns that you understand that there are risks, dangers and hazards associated with your participation in Activities at Home Lifestyle Club and that this agreement will be binding upon my heirs, next of kin, executors, administrators, representatives and assigns in the event of my death or incapacity.

By registering for Activities at Home Lifestyle Club, you are acknowledging that it is your responsibility to communicate any physical or psychological concerns that may prevent you from taking part in any Activity. You are confirming that you have been given permission by your physician to participate in the Activities OR you are voluntarily accepting all the attendant risks and releasing Home Lifestyle Club (without limitation) from any and all liability and claims for any injuries, disability, death or loss or damage to person or property incurred if participating in the Activities that occur to to or in part due to any and all known or unknown medical conditions, injuries, illnesses, ailments, allergies or medications.

Registering for Home Lifestyle Club Activities signals acknowledgment that you have read the Home Lifestyle Club Rules on the Home Lifestyle Club website and that you agree to comply with all rules that are relayed, including but not limited to web-based, verbal, and posted rules as well as customary and common sense rules.

You confirm your understanding that said Home Lifestyle Club Rules may be subject to periodic updating and you assume the responsibility for being aware of rule changes.

In registering for Home Lifestyle Club Activities, you acknowledge that your right to attend Activities is solely under the discretion of Home Lifestyle Club and that Home Lifestyle Club has the sole right to refuse service to you for any reason whatsoever.

I understand Home Lifestyle Club does not accept the online registration of minors and affirm that I am over the age of 18. If under the age of 18, I acknowledge that Home Lifestyle Club has an Age Policy that states to be allowed to register for Activities, a parent or Guardian and the minor must come into the

Home Lifestyle Club Studio together and produce ID to verify both of their identities after which time if the minor meets any age or height requirements set by Home Lifestyle Club, the minor will then be given access to the Home Lifestyle Club Activity booking application.

Acknowledging that Home Lifestyle Club requires a limited amount of my personal information in order to register for Activities, I agree to voluntarily provide an accurate name, address, email address, phone number, credit card, and bank account information. I authorize Home Lifestyle Club the right to share my information when required by law enforcement or government agencies (or other companies authorized by these agencies) if the need arises to assist in criminal investigations or to protect against actual/perceived fraudulent activity or threats of the same. I will not create false or duplicate accounts for the purpose of misleading customer records. I understand that I have the right to request that my personal information is removed from Home Lifestyle Club records but after which time I will no longer be provided services from Home Lifestyle Club.

I acknowledge my awareness that Home Lifestyle Club uses Cookies (small files stored by Home Lifestyle Club to help customize their service to me).

In exchange for being allowed to register for and attend Home Lifestyle Club activities, I give the irrevocable right to use my name/photograph/audio recording/image/video recording, and my likeness in all forms and manner including, but not limited to publication on Internet Web Sites, Broadcasts, and or any other publications. I understand that Home Lifestyle Club cannot control unauthorized use of my image by persons not associated with Home Lifestyle Club if published by that entity.

I acknowledge that Activity doors are closed 1 minute before an Activity starts and I will not be allowed to take part in an Activity if I am late.

I am aware that when I open a Home Lifestyle Club account, I am automatically going to receive their Newsletter and Class confirmations.

I acknowledge that Home Lifestyle Club has a Home Lifestyle Club RULES page on their Website that includes Rules for Cancellation of Memberships, Freezing Memberships and Refund Rules, Waitlists, and Check-in times and that it is my responsibility to review these from time to time for any periodic updates.

I acknowledge that I have read the above TERMS and CONDITIONS and understand I have the right to consult Legal advice prior to agreeing to this document.

I affirm that I have had sufficient time to read and understand this Agreement and any/all schedules/Website info referred to herein.
